1. GENERAL INFORMATION

These General Terms and Conditions regulate the use (including mere access) and operation of the itcl.es website.

In compliance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the website itcl.es is owned by INSTITUTO TECNOLÓGICO DE CASTILLA Y LEÓN (hereinafter, ITCL), with registered office for notification purposes at C/ López Bravo 70, 09001 Burgos, Tax ID Number G09226606 and email address info@itcl.es

2. ACCEPTANCE OF THE TERMS OF USE

The use of this website attributes the condition of User of the site to the navigator, which implies adherence to these General Conditions in the version published at the time of access. Therefore, ITCL recommends that the User read them carefully each time they access the website.

Consequently, it is the responsibility of all visitors and/or Users to carefully read these General Terms and Conditions of Use each time they access this website. If you do not agree with any of the conditions set forth herein, you must refrain from using this website.

ITCL may alter the design, presentation and/or configuration of the website, as well as some or all of the content, at any time and without prior notice to the user, and may modify the general conditions and/or specific conditions required to use them.

3. USE OF THE SITE

The User is aware and voluntarily and expressly accepts that the use of the itcl.es website is in all cases under their sole and exclusive responsibility.

When using the itcl.es website, the User undertakes not to engage in any conduct that could damage the image, interests and rights of ITCL or third parties, or that could damage, render useless or overload the website, or that could in any way prevent the normal use of the website.

ITCL shall not be liable for the use that third parties make of the information published on the portal, nor for any damages or economic losses that, directly or indirectly, cause or may cause economic, material or data damage, caused by the use of such information.

4. INDUSTRIAL AND INTELLECTUAL PROPERTY

The User acknowledges and accepts through these General Conditions that all industrial and intellectual property rights over the contents and/or any other elements inserted in this website (including, without limitation, trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, flow charts, presentation, look-and-feel, audio and video) are the exclusive property of ITCL and/or third parties, who have the exclusive right to use them in economic traffic.

Under no circumstances does access to the website imply any kind of waiver, transfer, licence or total or partial assignment of these rights, unless expressly stated otherwise. These General Conditions of Use of the website do not confer on Users any other right to use, alter, exploit, reproduce, distribute or publicly communicate the website and/or its contents other than those expressly provided for herein. Any other use or exploitation of any rights shall be subject to the prior and express authorisation specifically granted for this purpose by the TECHNOLOGICAL INSTITUTE OF CASTILLA Y LEÓN or the third party owner of the rights concerned.

Any claims that may be brought by Users or third parties in relation to possible breaches of intellectual or industrial property rights over any of the contents of this website should be addressed to the following email address info@itcl.es with the following information:

1.- Name and surname(s), postal address and email address of the affected party or, where applicable, of the person authorised to act on their behalf, indicating the title by virtue of which they hold representation (hereinafter, the claimant).

2.- Statement by the claimant affirming that they are the owner of the rights allegedly infringed, including their physical or digital signature.

3.- Precise description of the content protected by the intellectual property rights allegedly infringed, as well as its exact location within the website.

4.- Express statement by the claimant that the use of the content has been made without the consent of the owner of the rights allegedly infringed.

4.1 Domain names

In the same vein as the previous section, the domain name itcl.es and all those used to directly access this site are the exclusive property of ITCL. The improper use of these in economic traffic would constitute an infringement of the rights conferred by their registration and will be prosecuted by the means provided for in the legal regulations.

4.2 Copyright

The contents, texts, photographs, designs, logos, images, sounds, videos, animations, recordings, computer programs, source codes and, in general, any intellectual creation existing on this site, as well as the site itself as a whole, as a multimedia artistic work, are protected as copyright by intellectual property legislation.

4.3 Personal use

ITCL authorises Users to use, view, obtain a temporary copy, download and store the content and/or elements inserted on the website exclusively for their personal, private and non-profit use, provided that the origin and/or author of the same is indicated in all cases and that, where applicable, the copyright symbol and/or industrial property notes of their owners appear.

The use of such elements, their reproduction, communication and/or distribution for commercial or profit-making purposes, as well as their modification, alteration or decompilation, is strictly prohibited.

For any use other than those expressly permitted, it will be necessary to obtain the prior written consent of the owner of the rights in question.

Users of this website undertake to respect the rights set forth herein and to refrain from any action that could prejudice them, with ITCL reserving the right to exercise any legal means or actions available to it in defence of its legitimate intellectual and industrial property rights.

5. EXCLUSION OF GUARANTEES AND LIABILITY

5.1 Exclusion of guarantees and liability for the operation of the Portal

ITCL does not guarantee the availability and continuity of the website’s operation. Furthermore, ITCL shall in no case be liable for any damages that may arise from:

1. The lack of availability or accessibility of the website;

2. Interruption in the operation of the website or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in telephone lines, the Internet system or other electronic systems produced in the course of its operation;

3. The unsuitability of the website for the specific needs of Users; and

4. Other damages that may be caused by third parties through unauthorised interference beyond the control of ITCL.

The absence of viruses or other elements on the website introduced by third parties unrelated to ITCL that may cause alterations to the physical or logical systems of Users or to the electronic documents and files stored on their systems is not guaranteed.

ITCL adopts various protective measures to protect the website and its contents against computer attacks by third parties. However, it does not guarantee that unauthorised third parties will not be able to access the type of use of the website made by the User or the conditions, characteristics and circumstances in which such use is made. Consequently, it shall in no case be liable for any damages that may arise from such unauthorised access.

5.2 Exclusion of guarantees and liability for the use of the Portal, services and content by Users

ITCL shall not be liable in any case for the use that Users and/or third parties may make of the website or its content, nor for any damages that may arise from such use.

ITCL excludes any liability for damages of any kind that may arise from the use of the services and content by Users or that may arise from the lack of accuracy, validity, completeness and/or authenticity of the information that Users provide about themselves and, in particular, but not exclusively, for damages of any kind that may arise from the impersonation of a third party by a User in any kind of communication made through the portal.

5.3 Exclusion of guarantees and liability for the Content

ITCL shall in no case be liable for any damages that may arise from:

1. Damages of any kind that may be due to the lack of legality, reliability, usefulness, truthfulness, accuracy, completeness and timeliness of the content.

2. The unsuitability for any purpose and the disappointment of the expectations generated by the Content.

6. PERSONAL DATA

Simply visiting the website itcl.es does not automatically record any personal data that identifies a User. However, certain non-personal information that cannot be identified with a specific User may be collected and stored on ITCL’s Internet servers (e.g. the User’s Internet browser type and operating system) in order to improve the User’s browsing experience and the management of the itcl.es website.

ITCL may require certain personal data from the User for the use of certain content or services, complying at all times with Regulation (EU) 2016/679 and Organic Law 3/2018 of 5 December on the protection of personal data and the guarantee of digital rights.

The duration of this site is, in principle, indefinite. However, ITCL reserves the right to modify, suspend or terminate the provision of its services at any time and without prior notice, as well as these General Conditions. 

8. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Use are governed by Spanish law. Any dispute relating to the itcl.es website shall be settled before the Spanish courts, with the parties submitting to the Courts and Tribunals of the city of Burgos and their hierarchical superiors, expressly waiving any other jurisdiction they may have if different from those outlined above.
